Shop terms & conditions

  1. FabricArt online shop and FabricArt brand owner is :

  2. Orders are shipped directly from Poland.

  3. Orders for the fabrics available in the on-line shop can be placed via https://pl.fabricart.eu/ website.

  4. Orders can be placed 24/7 through the year.

  5. For an order to be processed, the order form must be filled correctly and personal information given. Every order will be confirmed via e-mail.

  6. At the moment of placing the order by clicking the "Order with obligation to pay" button Buyer agrees on his/her personal data processing by LennyLamb Sp. z o.o. Sp. k. in order to process and fulfill Buyer's order in the correct and complete way. 

  7. Confirmed orders cannot be canceled.

  8. LennyLamb staff will verify any doubtful orders. LennyLamb reserves the right to confirm and potentially cancel any order(s) that deem questionable. The ordering party will be informed of this fact.

  9. Order processing time and shipping fee:
    Order processing time is 1-3 working days from payment confirmation. Customer is informed about the total postage price during the ordering process and before the order is confirmed. In the case of orders exceeding 10 meters, the customer service is entitled, through separate arrangements with the Customer, to specify a longer delivery time and shipping costs for the order.

  10. Prices in Fabricart on-line shop are shown in Polish Zloty/ Euro / American Dollars / British Pounds and are inclusive of VAT tax (gross price). Customs fees, import duties and taxes vary by country and product. Calculation and payment of these charges are the sole responsibility of the buyer. If ordered goods are incorrectly priced due to server or human error, the order will be canceled and the customer informed.

  11. In the event that the fabric is unavailable / out of stock, and, as a result, order processing time will take longer, LennyLamb will inform the customer about this fact. If the customer does not agree to the extended order processing time, the customer has the right to cancel the order.

  12. There is a receipt attached to every order.

  13. Orders are dispatched as soon as 100% payment reaches the LennyLamb bank account. Its dispatch takes place within the time specified in point 9 of the General shopping terms.

  14. The customer has the right to return the goods without giving any explanation within 30 days from the date of receipt of the order. In order to do this, you must first contact the seller (contact@fabricart.eu) and inform them at the same time about sending the safely packed goods together with the receipt / proof of purchase to the following address: LennyLamb Sp. z o.o. Sp. K., 97-330 Sulejów, Kłudzice 9. In the case of an e-mail notification, the seller will send feedback to the customer about receiving the declaration of withdrawal from the contract. The returned goods should not show any signs of use, and in particular may not be washed, dirty, cut or damaged in any other way. In the event of withdrawal from this contract, the seller will refund the received payments for the goods and including the cost of delivering the goods (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the seller). The Customer will receive the payment for the returned goods by transfer to the indicated bank account number within 14 working days, counted from the date of receipt of the returned goods by the seller. The condition for the refund is the receipt of the returned goods by the seller. The cost of returning the goods is borne entirely by the consumer. In accordance with art. 38 point 3 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827), the right to withdraw from a distance contract does not apply to the consumer in relation to contracts in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet their individual needs. Fabric cut from a roll according to the customer's preferences constitutes "an item intended to meet their individual needs" within the meaning of art. 38 point 3 of the Act of 30 May 2014 on consumer rights. As a result of the sale of this type of product, the consumer does not have the statutory right to withdraw from the contract.

  15. Prices listed in the on-line shop listed in point 2 are not an offer of contract under Civil Law, they are only an invitation for the customer to place an order.

  16. Order placed via the above listed site or placed directly by the customer is an offer of contract under Civil Law.

  17. The colors of fabrics presented on the shop’s website may differ slightly from the actual ones due to the fact that there is no universally calibrated monitor, and each monitor on which photos of fabrics from our website are displayed may display colors differently

  18. The foregoing provisions exclude all other warranties or guarantees, whether expressed or implied.


CONDITIONS FOR ACCEPTING A COMPLAINT

for withdrawal from the contract due to non-conformity of the goods with the order or defective goods

  1. For the complaint to be accepted there needs to be an original receipt attached.

  2. If the purchased goods are defective or inconsistent with the order, you can file a complaint under the non-conformity of the goods with the contract.

  3. The complaint can be filed by e-mail to contact@fabricart.eu on a legibly completed complaint form.

  4. The complaint will be considered within 14 days from the date of delivery of the damaged goods to the company address: LennyLamb Sp. z o.o. Sp. K., 97-330 Sulejów, Kłudzice 9.

  5. The cost of shipping the goods subject to the complaint is covered by the seller.
